Terms of Service
Terms governing your use of the Fastidelity platform.

These Terms of Service (the “Terms”) govern access to and use of the Fastidelity loyalty platform (the “Service”), operated by Marcelo, who provides the Service as a natural person (“Fastidelity”, “we”). You can contact us at hello@fastidelity.com.
By creating an account or using the Service you accept these Terms in full. If you do not agree, you must not use the Service.
1. The Service
Fastidelity is a multi-tenant SaaS platform that lets merchants create and manage loyalty programs, issue digital passes for Apple Wallet and Google Wallet, scan QR codes, manage customers and send communications.
The Service is provided “as is” and may evolve over time. We may add, change or discontinue features, giving you reasonable notice when a change is material.
2. Accounts and eligibility
To use the Service you must register an account with truthful, complete and up-to-date information, and be of legal age or otherwise able to enter into a contract in your jurisdiction.
You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.
3. Plans, billing and free trial
Some plans are paid and billed in advance according to the selected cycle (monthly or annual). Payments are processed through third-party providers such as Mercado Pago.
If your plan includes a trial period, you will be charged automatically when it ends unless you cancel beforehand. Amounts paid are non-refundable unless applicable law provides otherwise.
- Prices may change; we will notify you before applying changes to your billing cycle.
- Applicable taxes may be added depending on your country.
- Non-payment may result in suspension or termination of the account.
4. Acceptable use
You agree to use the Service in accordance with the law and these Terms. In particular, you must not:
- Infringe third-party rights or the privacy of your end customers.
- Send unsolicited communications (spam) or messages without a proper legal basis.
- Attempt to access the platform, other tenants or third-party data without authorization.
- Upload illegal, deceptive or malicious content.
- Resell or sublicense the Service without written authorization.
5. Your end-customer data
When you upload data about your customers (consumers of your business) into Fastidelity, you act as the data controller and we act as a processor handling that data on your behalf and per your instructions.
You are responsible for having the legal basis and consents needed to process that data and to send the communications you configure. Processing of personal data is further governed by our Privacy Policy.
6. Intellectual property
Fastidelity and all its components (software, trademarks, designs) are owned by Marcelo or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is active.
Content you upload (logos, copy, campaign images) remains yours; you grant us a license to host and process it solely to provide the Service.
7. Availability and support
We strive to keep the Service continuously available but do not guarantee it will be uninterrupted or error-free. We may perform scheduled maintenance.

8. Limitation of liability
To the maximum extent permitted by law, Fastidelity shall not be liable for indirect damages, lost profits or data loss arising from the use of or inability to use the Service.
Our total aggregate liability is limited to the amount you paid in the twelve (12) months preceding the event giving rise to the claim.
9. Suspension and termination
You may close your account at any time from the platform or by contacting us. We may suspend or terminate your account for breaches of these Terms or legal requirements.
After termination we will retain or delete data in accordance with our Privacy Policy and applicable law.
10. Changes to the Terms
We may update these Terms. If changes are material, we will notify you by reasonable means. Continued use of the Service after the effective date constitutes acceptance.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Oriental Republic of Uruguay. Any dispute shall be submitted to the competent courts of Montevideo, Uruguay, without prejudice to consumer rights granted by law.
